Terms of Service

This is a binding agreement between you and Back to the Points ("BTTP", "we", "us"), operated by Back To The Points Pvt. Ltd. It is an electronic record under the Information Technology Act, 2000, and is generated automatically - no physical or digital signature is required for it to be valid. These terms cover this pre-launch waitlist site as it exists today, and also describe - in advance - how they are expected to extend to the BTTP app once it launches. They will be reviewed and re-published before that app goes live. By using this site or joining the waitlist, you agree to these terms; if you don't agree, please don't use the site.

Definitions

  • "Site" means this website, backtothepoints.com.
  • "App" means the BTTP mobile application, once released.
  • "You" / "User" means anyone who visits the Site, joins the waitlist, or (once released) uses the App.
  • "Rewards Data" means information about your credit cards, airline miles, hotel points or other loyalty programs that you provide or that the App detects with your consent, as described in our Privacy Policy.

Changes to these terms

We may update these terms as the product develops. Continuing to use the Site or App after an update means you accept the revised terms. We will update the "Last updated" date above whenever we do.

Eligibility

You must be at least 18 years old and capable of entering into a binding contract under applicable law to join the waitlist or use the App. You're responsible for any activity that happens under the contact details or account you provide.

Using the waitlist, and the App once it launches

Today, this is a marketing site to collect interest ahead of launch. Joining the waitlist does not create an account, subscription or contract for any financial product, and does not guarantee access to BTTP when it launches. Once the App launches, we expect to require one account per person, accurate registration details, and reasonable steps from you to keep your account credentials confidential and to tell us promptly about any unauthorized use.

SMS-based transaction detection (planned, for the App)

As described in our Privacy Policy, the App is designed to optionally read bank and card-issuer transaction SMS alerts on Android, with your explicit and revocable consent, to automatically calculate the points and miles your transactions earn. This is optional: you can decline it and use manual entry instead. We are not responsible for missed or miscalculated transactions if your device, carrier or bank changes how these alerts are sent, or if you decline this permission.

What we ask of you (prohibited activities)

  • Give us contact details (email, and optionally a phone number) that are genuinely yours, and don't submit the waitlist form on behalf of someone else without their permission.
  • Don't attempt to abuse, flood, scrape or automate submissions to this Site, its waitlist form, or its underlying API.
  • Don't attempt to reverse-engineer, decompile, hack, or gain unauthorized access to the Site, the App (once released), or the systems behind them.
  • Don't use the Site or App for anything unlawful, fraudulent, or intended to harm BTTP or other users.

Intellectual property

The Site's content, design, logo and branding belong to BTTP (or are used under license) and are provided for your personal, non-commercial use only. You may not copy, reproduce, or redistribute them without our prior written permission.

Accuracy of content; not financial advice

We try to keep the Site accurate, but we don't guarantee that its content is complete, current, or error-free. Nothing on this Site or, once released, in the App constitutes financial, tax or investment advice - it's a tool to help you track and understand rewards you've already earned.

Third-party links

The Site or App may link to third-party sites or services we don't control. We don't endorse them and aren't responsible for their content, policies, or practices.

No warranty

This Site and the waitlist (and, once released, the App) are provided "as is" and "as available," without warranties of any kind, express or implied, including as to accuracy, availability, or fitness for a particular purpose, while BTTP is in development.

Limitation of liability

To the maximum extent permitted by law, BTTP will not be liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site, the waitlist, or the App.

Indemnification

You agree to indemnify and hold BTTP harmless from any claim or demand arising out of your violation of these terms or misuse of the Site or App.

Communications

By joining the waitlist you consent to receive emails (and, if you provide one, SMS) from us about early access and product updates. You can opt out of non-essential communications at any time by emailing info@backtothepoints.com or using the unsubscribe link in our emails.

Termination

We may suspend or terminate your access to the waitlist or App if we reasonably believe you've violated these terms, without prior notice where warranted (for example, abuse of the waitlist API). You can ask us to delete your data at any time - see our Privacy Policy.

Severability & waiver

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term isn't a waiver of our right to do so later.

Governing law

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts of Mumbai, India.
